TERMS AND CONDITIONS

Starting April  7, 2025, enter by submitting a video sharing your experience with American Mane. Video can be submitted via one of the following two options: 1. via our dedicated webpage at: www.americanmane.com/contest or 2. by email at marketing@americanmane.com.  American Mane will post the videos on some of our social media pages, and the ones with the most views will receive one of the great prizes listed below.

 

LIST OF PRIZES AND ENTRY INSTRUCTIONS:

 

Create a video using your camera or cell phone describing your experience with American Mane. Video should include photos before and after photos of your procedure on different time frames. Then send us your videos using one of the methods we described. Entries must be received between 12:00 AM EDT on April  7, 2025, and 11:59 PM EDT on May  15, 2025. 

 

Entries must be a single video, which should meet the following criteria: 

 

-The video should describe your experience with American Mane's products and services;

 

-Be no more than 5 minutes long, and in a format that is easily uploadable to social media platforms;

 

-Must not violate the terms and conditions of Facebook, Instagram, X, Pinterest, TikTok, YouTube, or any other social media platform used by American Mane;

 

-Must not contain any foul or threatening language, racial epithets, or otherwise disparaging remarks or comments about any person or place;

 

-Must not make any false or misleading claims about the results obtained from or by American Mane's services;

 

-Must not contain any clothing, artwork, posters, cars, or other items which contain copyrighted or trademarked images (i.e. logos, emblems, brand names, etc.), and should not mention any other company name;

 

-The video should not show or mention anyone's name besides your own, and should not show anyone's face other than yours;

 

Only submissions meeting all of the requirements above will be considered. 

 

You will have a chance to win one (1) of the following prizes:

 

First Place - Vacation in Punta Cana - Dominican Republic;

Second Place - Vacation in Miami, Florida; and

Third Place - One (1) year supply of American Mane’s vitamin supplements.

SELECTION OF WINNERS AND NOTIFICATION:

 

All videos will be posted on American Mane's social media page on the same day following the closure of the entry period.  The precise day has not been determined, but will be on or before May 30, 2025.

 

The video that gets the most views across all platforms on which it is posted will receive the first place prize, the second most will receive the second place prize, and the third most will receive the third place prize.  

 

The measuring period shall begin on the day the videos are posted, and will continue until August  30, 2025. .

 

Winners will be notified by September  15, 2025 by email using the email account associated with their winning contest entry.

 

Videos and Entry information including name and location may be used by American Mane at any time in a variety of marketing materials in perpetuity.  The contest entry videos may or may not remain on American Mane's social media pages/accounts beyond the closing of the contest.  Your entry into the contest constitutes your consent to American Mane's use of your video in perpetuity.

 

ELIGIBILITY AND TERMS AND CONDITIONS:

 

The American Mane Video Testimonial Contest is only open to residents of the United States who are at least twenty-one (21) years of age.   The contest and offer to participate and enter is void where prohibited by state or federal law.

 

Each Entrant can earn up to one (1) prize during the Contest period. Odds of winning will be based on the engagement of the public with the entrant's video. An “individual” is defined as a single natural person meeting all other eligibility requirements stated herein and who has not attempted to enter multiple times using different accounts.  Attempts to enter more than once will result in disqualification of all entries.

 

All prizes or valuations herein are in United States Dollars (USD).  The value of each of the prizes will be as listed in the full prize description below.  

 

All winners will have seven (7) calendar days to claim their prize and provide all details necessary to claim the prize (i.e. name, address, date of birth, proof of passport, etc.), calculated beginning on the date the notification is sent to the email address used to make the initial submission.  American Mane will not accept any request to change the email address after entry.  Attempts to resubmit an entry using a different email address will be considered a multiple entry and result in disqualification.   Alternate winners may be randomly selected for any unclaimed prizes.  Prizes which include travel must be used within one (1) year of winning.

 

Participation in the contest constitutes agreement and acceptance of these rules and the decisions of the American Mane staff member administering the contest.  All such decisions are final, binding, and not subject to appeal.  Entrants must comply with all of the terms and conditions listed herein in order to win and claim a prize. 

 

As mentioned above any attempt by an entrant to obtain more than one entry by using multiple/different identities/accounts, and/or any other methods, including AI, "deepfakes", or other means of disguising the entrant's true identity, or by making false claims about their experience with American Mane, or any results they obtained, will void that entrant’s entry and any other duplicate entries he/she may have tried to make.  

 

American Mane reserves the right to disqualify any person who violates, or is suspected of violating these rules and conditions.  If American Mane reasonably  suspects any fraud, tampering, or other misconduct that American Mane reasonably believes affects the actual or apparent integrity of the contest, American Mane may, in its sole and absolute discretion, disqualify any and all affected entries.

 

For the purpose of calculating time, American Mane's computer, or an external source or application it determines shall govern.

 

Prizes are not transferrable and have no cash value.  

 

American Mane may amend these rules, terms, and conditions, or terminate the contest at any time, and without advanced written notice.  

 

If due to unforeseen circumstances, American Mane reserves the right to change the prizes without advanced written notice.  Examples of unforeseen circumstances include, but are not limited to: travel advisories, pandemic, natural disaster, war, material increase in costs, etc.  

 

Winners receiving a prize which includes travel are solely responsible for any rebooking, transfer, or change fees, including any increase in costs due to traveling at a different time, or on short notice.  American Mane shall not reimburse or pay for any such expenses, nor shall it offer a substitute prize if the winner, or a member of his/her party is unable to travel for any reason whatsoever. 

 

Participants agree to and accept all applicable laws, regulations, these rules, terms, and conditions, and the decisions of American Mane in administering the contest, all of which are final and binding.

 

Additionally, contest participants agree to release and hold harmless American Mane, its officers, directors, employees, and agents from and against any claim or cause of action arising out of the contest or prizes, except where such a waiver is not permissible, in whole or in part, due to state law.  Additionally, American Mane is not responsible for any harm, harassment, or other injury which stems from public interaction with an entrant's video.

 

All federal, state, and local income taxes connected to the prize are the sole responsibility of the winner, and the value will be reported to the appropriate taxing authority.  All federal, state, and local laws and regulations apply.  Any resident of the United States who receives a prize worth over $600 USD, will receive an IRS Form 1099-MISC from American Mane. 

 

American Mane is not responsible for any failure of its email service, an entrant's email service, or any of the social media platforms on which the entrant videos are posted.  Additionally, American Mane is not responsible for any takedown, suspension, removal, content flagging, or other similar action by the hosting platform which affects, or could affect the video's performance in the contest.  

 

The restrictions and conditions stated herein are not all-inclusive and may be subject to additional restrictions and conditions.

 

LIABILITY RELEASE:

 

By participating entrants agree to release and hold harmless American Mane, and any social media platform on which the entrant's video is posted as well as their respective parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the contest or the receipt and use of any prize.  By way of example only, and not of limitation, this release includes: (a) unauthorized intervention in the contest; (b) technical errors related to computers, servers, providers, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the contest or receipt or use of any of the prizes.  

 

AMERICAN MANE EXPRESSLY DISCLAIMS, AND ALL ENTRANTS RELEASE AMERICAN MANE FROM, ANY CLAIM FOR DAMAGES OF ANY KIND OR NATURE WHICH RESULT FROM THE ONLINE CONDUCT OF OTHERS, INCLUDING BUT NOT LIMITED TO POSTS WHICH BULLY, HARASS, DEMEAN, DEFAME, OR ARE OTHERWISE INAPPROPRIATE OR AGAINST SOCIAL NORMS. AMERICAN MANE IS UNDER NO OBLIGATION TO POLICE OR MONITOR THE COMMENTS OR INTERACTIONS OF THE PUBLIC ON ITS SOCIAL MEDIA PAGES. AMERICAN MANE’S DELETION OF A PARTICULAR COMMENT OR INTERACTION, BUT NOT ANOTHER, SHALL NOT BE CONSIDERED AN ENDORSEMENT OF THE REMAINING COMMENT OR INTERACTION.

 

Entrants further agree that in any cause of action, the Released Parties’ liability shall be limited to five hundred dollars ($500).  Under no circumstances, other than if required by applicable statute or common law, shall any of the Released Parties be liable for attorney’s fees, punitive, consequential, direct, or indirect damages, and entrants waive the right to collect or pursue any such damages.  The maximum liability of any Released Party is an aggregate of five hundred dollars ($500). 

 

PRIVACY:

 

American Mane will, by virtue of the submission content and process, and prize award, collect personal data about contest entrants.  By participating in the contest, entrants agree to the collection and usage of your personal information.  By entering, entrants also agree that American Mane may refer or re-post contest entries, may shorten or otherwise edit entries for future use so long as the resulting edits do not meaningfully alter the content thereof such that the edited version is misleading. 

 

All entrants expressly waive any right or claim they may have under any patient privacy law or regulation, whether by statute, administrative rule, or under the common law, including HIPAA-HITECH, and Section 456.057, Florida Statutes, or any comparable and applicable law or rule in another jurisdiction.

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of contest entrants shall be governed by, and construed in accordance with, the laws of the State of Florida.  Venue for any claim or cause of action arising out of, or related to the contest shall be in the state or federal courts in and for Miami-Dade County, Florida.  

 

American Mane is the sponsor of this contest.  After its conclusion, requests for a complete list of winners may be obtained by sending a self-addressed stamped envelope post-marked no later than September 30, 2025, to:
