TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your access to and use of www.americanmane.com, the My Mane Hair mobile application ("App"), and any services, consultations, products, or communications provided by American Mane ("Company," "we," "us," or "our") (collectively, the "Services"). By accessing the Website or downloading and using the App, you agree to be legally bound by these Terms.

Medical Disclaimer

All content provided through our Services, including text, graphics, images, videos, post-operative care guides, treatment tracking features, testimonials, and other materials, is for informational and personal tracking purposes only and does not constitute medical advice, diagnosis, or treatment. Use of the Services does not establish a physician-patient relationship. Individual results vary and are not guaranteed. Always follow the specific instructions of your treating physician, which take priority over any guidance provided in the App.

Eligibility

You must be at least 18 years of age to use the Services or schedule appointments. By using the Services, you represent that you meet this requirement.

User Accounts

To access certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may sign in using email/password, Google, or Apple Sign In. You agree to provide accurate and complete information when creating your account.

You may request deletion of your account at any time from within the App (Profile → Delete Account). Upon deletion, your account, progress photos, treatment history, and all associated personal data will be permanently removed from our systems within 30 days. Some data may be retained longer if required by law.

User-Generated Content & Progress Photos

The App allows you to upload and store progress photos ("Photos"). You retain ownership of all Photos you upload. You grant American Mane a limited, non-exclusive license to store your Photos solely for the purpose of providing the Service to you. We will never share, sell, or display your Photos to third parties without your explicit consent. You may delete your Photos at any time within the App.

Health & Medical Data

The App collects and stores health-related information including your hair loss stage (Norwood scale), transplant procedure dates, treatment logs, and prescription request history. This data is stored securely using Supabase (a SOC 2-compliant cloud provider) and is accessible only to you and authorized American Mane staff when necessary to fulfill a service request. We do not sell your health data.

You may request a copy or deletion of all your personal data by contacting info@americanmane.com.

Prescription Request Service

The App allows you to submit a prescription consultation request. The $99 consultation fee covers a licensed physician's independent review of your health history. Submission of a request and payment of the fee do not guarantee issuance of a prescription — the physician makes all prescribing decisions independently based on medical judgment. If a prescription is denied, refund eligibility will be addressed on a case-by-case basis. Contact info@americanmane.com for refund inquiries.

This service is available to US residents only. Medications are dispensed by licensed US pharmacies.

Scheduling & Clinical Services

By scheduling a consultation or procedure, you agree to:

• Provide complete and accurate medical history

• Follow all pre- and post-procedure instructions

• Execute separate written treatment consent forms prior to procedures

• Understand that all medical procedures carry inherent risks

Treatment outcomes depend on individual factors and cannot be guaranteed.

Payments & E-Commerce

All prices are subject to change without notice. Online transactions are processed through secure, PCI DSS-compliant payment providers including Stripe (for in-app purchases and consultation fees) and Wix Payments (for website orders). We reserve the right to refuse or cancel orders due to suspected fraud, pricing errors, or payment issues.

Refund eligibility, if applicable, is governed by separate written policies provided at time of service or purchase.

Third-Party Services

The Services integrate with the following third-party providers:

• Supabase — cloud data storage and authentication

• Stripe — payment processing

• Google / Apple — optional sign-in authentication

• Resend — transactional email delivery

• Wix — e-commerce for physical product orders

Each provider operates under its own privacy policy and terms. We are not responsible for the practices of third-party services.

Push Notifications

The App may send push notifications for treatment reminders and appointment follow-ups. You may opt out of notifications at any time in your device Settings → Notifications → My Mane Hair.

Apple App Store & Google Play

If you downloaded the App from the Apple App Store or Google Play, your use is also subject to their respective terms of service. Apple Inc. and Google LLC are not parties to these Terms and have no obligation to provide maintenance or support for the App.

Intellectual Property

All Website and App content, trademarks, logos, designs, videos, graphics, and text are the exclusive property of American Mane and are protected under US copyright and trademark laws. You may not reproduce, distribute, modify, or exploit any content without prior written consent.

Prohibited Use

You agree not to:

• Use the Services for unlawful purposes

• Attempt to gain unauthorized access to systems or data

• Interfere with Service functionality

• Submit false or misleading information

• Use automated systems (bots, scrapers) without permission

Limitation of Liability

To the fullest extent permitted by Florida law, American Mane shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Services, reliance on content, technical interruptions, or medical outcomes. Our total liability shall not exceed the amount paid for the specific service or product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless American Mane, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or misuse of the Services.

California Privacy Rights (CCPA)

California residents have the right to request disclosure of personal information collected, request deletion of personal data, and opt out of the sale of personal information. We do not sell personal information. To exercise your rights, contact info@americanmane.com.

Governing Law & Venue

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the Services after updates constitutes acceptance of the revised Terms.

SMS/Text Messaging Terms

By consenting to receive SMS/text messages from American Mane, you agree to receive appointment reminders, treatment follow-ups, service notifications, and promotional offers. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance.
